1. Acceptance of Terms
By creating an account or using The Market & Strategy, you agree to these Terms of Service ("Terms") and our Privacy Policy. These Terms constitute a binding legal agreement between you and The Market & Strategy. If you do not agree, do not use our service.
2. Description of Service
The Market & Strategy is a financial indicators platform that provides real-time RSI and Stochastic Oscillator analysis for stock market analysis ("the Service"). Features vary by subscription plan.
3. Accounts
3.1 Registration
To use the Service, you must create an account with a valid email address and password. You are responsible for keeping your credentials secure.
3.2 Account responsibility
You are responsible for all activity under your account. Notify us immediately if you suspect unauthorized access: support@themarketandstrategy.com
3.3 Age requirement
You must be at least 18 years old to create an account. By registering, you represent that you are 18 or older.
4. Free Trial
New accounts receive a 2-month trial at no charge, with no credit card required. At the end of the trial, your account access expires. You may upgrade to a paid plan at any time.
5. Subscriptions and Payment
5.1 Paid plans
Paid subscriptions are billed monthly at $50/month. Prices are in US dollars and subject to applicable taxes.
5.2 Billing
Payments are processed by Stripe. By subscribing, you authorize Stripe to charge your payment method on a recurring basis. You can update your payment method or cancel at any time.
5.3 Cancellation
You may cancel at any time. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial periods.
5.4 Refunds
Subscription fees are generally non-refundable. If you believe you've been charged in error, contact billing@themarketandstrategy.com within 30 days.
6. Acceptable Use
You agree to use the Service only for lawful purposes. You agree not to:
- Use the Service in violation of applicable law
- Upload or transmit malicious code or harmful content
- Attempt unauthorized access to the Service or other accounts
- Use automated tools to scrape or extract data
- Reverse-engineer or disassemble any part of the Service
- Use the Service for unlawful or defamatory content
- Impersonate any person or entity
7. Your Content and Data
7.1 You own your data
You retain full ownership of all trading data, watchlists, and content you enter into The Market & Strategy. We claim no intellectual property rights over your data.
7.2 License to operate
By using the Service, you grant us a limited license to store, process, and transmit your data solely as necessary to provide the Service. This license ends when you delete your data or close your account.
7.3 Data accuracy
You are responsible for the accuracy of the information you enter. The Market & Strategy is an analysis tool — it does not verify data, validate recommendations, or provide professional financial advice.

9. Third-Party Services
The Service integrates with Stripe (payments) and Amazon Web Services (infrastructure). Your use of these services is governed by their terms and privacy policies. We are not responsible for their practices.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
We make reasonable efforts to maintain the Service but do not guarantee availability, accuracy, or completeness of information.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE MARKET & STRATEGY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF (A) AMOUNT PAID IN THE PRECEDING 12 MONTHS, OR (B) $100 USD.
12. Indemnification
You agree to indemnify, defend, and hold harmless The Market & Strategy from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service or violation of these Terms.
13. Termination
13.1 By you
You may close your account at any time by contacting support@themarketandstrategy.com. We will delete your data within 30 days.
13.2 By us
We may suspend or terminate your account if you materially breach these Terms or use the Service unlawfully. We will provide notice where reasonably possible.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you by email of material changes at least 14 days before they take effect. Your continued use constitutes acceptance.
15. Governing Law
These Terms are governed by the laws of the United States. Any disputes shall be subject to the jurisdiction of the courts where applicable.
